In this video, you should consider the following:
- To establish negligence, one must always establish a duty, which is the standard of care the defendant owes to the plaintiff.
- Duty is a reasonableness standard.
- You do not have to memorize the duty of every possible defendant: it will be the duty of a reasonable train conductor, highway driver, dog-owner, etc.
