Defenses: Assumption of the Risk
In this video, you should consider the following:
- Did the plaintiff assume the risk of what happened to him or her?
- If the plaintiff gets nauseous easily, and boards a roller coaster where a sign states that patrons should not ride the roller coaster if subject to motion sickness, and the plaintiff does so anyways and ends up vomiting and feeling so sick that he must return home, then the plaintiff has assumed the risk of his illness.
