Breach: Negligence Per Se (Statutory)
In this video, you should consider the following:
- The statute must cover a certain class of persons.
- The statute must be trying to prevent a particular kind of harm.
- Usually Negligence Per Se only established duty and breach.
- Even if the statute doesn’t cover your particular situation, still try applying a traditional negligence analysis, as your defendant can still be negligent.
