Damages: Joint Tortfeasors, Indemnification, Contribution
In this video, you should consider the following:
- Joint Tortfeasors: more than one defendant is liable to the plaintiff.
- Indemnification: both defendants are on the hook, but one defendant is fully indemnified by the other (it’s not my fault, it’s your fault) (imagine a vicarious liability situation where the employer sues the employee for indemnification).
- Contribution: where both defendants contributed the plaintiff’s injuries (It is my fault, but it is also your fault).
