This case involved whether the San Antonio Metropolitan Transit Authority (SAMTA) was subject to the minimum wage and overtime requirements of the FLSA. The district court ruled that SAMTA was immune from FLSA regulation. The controversy in the present cases has focused on the third Hodel requirement – that the challenged federal statute trench on traditional governmental functions. Lower courts have held that regulating ambulance services, licensing automobile drivers, operating a municipal airport, performing solid waste disposal, and operating a highway authority are functions protected. At the same time, lower courts have held that issuance of industrial development bonds, regulation of intrastate natural gas sales are not entitled to immunity.
