Derby Construction prepares a bid to erect a new school and got a quote of $120,000 from LaLa Interiors, who offered to do the cafeteria design work in the new school. The bid was 30 grand lower than Derby’s next lowest bid, so Derby decided to lower his bid by 20 grand before submitting it to the school. After he got the bid, and accepted LaLa’s offer, Lala’s president found that in prep of the quote he overlooked some installments for the cafeteria required for the plan.
Q. Assume the facts above except that LaLa sent their bid of $120K by telegram to Derby, but the telegraph company made a mistake and transmitted the bid as 20 grand. Derby uses this figure in preparing the bid for the school and LaLa refuses to perform. Will Derby prevail if they bring a claim for breach of contract?
