Hawaiian Independent Refinery, Inc.’s (Defendant) employee, Joshua Rellamas, caused an accident that killed people while driving under the influence of alcohol and marijuana. The accident occurred while Rellamas was on his way home from the Defendant’s premise, where he had been celebrating a recent promotion with co-workers. Beatrice Wong-Leong and Brian Sugimoto (Plaintiffs) brought separate actions against the Defendant for the deaths. The lawsuits were consolidated and the Defendant moved for summary judgment, arguing that they were not liable under theory of respondeat superior because Rellamas was not acting within the scope of his employment.
