Vaskie v. West American Insurance Co.

Anne Vaskie (plaintiff) was injured following a car accident with a car owned and operated by people who were insured by West American Insurance Company (“West American”) (defendant). Vaskie retained a lawyer to represent her for her personal injury claim. In November, West American offered Vaskie $25,000 to settle her claim. On December 1st, West American stated that its offer would remain at $25,000 a letter addressed to Vaskie’s lawyer. The letter did not specify when the offer would terminate. On January 9th, Vaskie’s lawyer notified West American that she unconditionally accepted the $25,000 offer. West American, however, refused to pay on the ground that the statute of limitations for Vaskie’s personal injury claim had run eight days prior to her acceptance. Vaskie sued West American for breach of contract.
