42 U.S.C. section 13981 provides a federal civil remedy for the victims of gender-motivated violence. Petitioner Christy Brzonkala enrolled at Virginia Tech, where she met respondents Antonio Morrison and James Crawford, who were both students and members of its varsity football team. Brzonkala alleges that they assaulted and repeatedly raped her. In 1995, Brzonkala filed a complaint against respondents under Virginia Tech’s Sexual Assault Policy. Virginia Tech’s Judicial Committee found Morrison guilty of sexual assault and sentenced him to immediate suspension for two semesters. Later that year, Virginia Tech set aside Morrison’s punishment concluding that it was excessive. As a result, Brzonkala dropped out of the university. In December 1995, Brzonkala sued Morrison, Crawford, and Virginia Tech alleging that Morrison’s and Crawford’s attack violated section 13981.
