Strawn v. Canuso
Citation:
657 A.2d 420 (1995).Facts
Strawn and more than 150 other families (the plaintiffs) bought new homes from the Canusos, their companies, and Fox & Lazo (the defendants). Unbeknownst to the plaintiffs, the homes were built near the Buzby Landfill, a hazardous waste dump. Toxic waste had been escaping from the Buzby landfill for years, leaching into the groundwater and contaminating it. The Buzby Landfill also released methane gas and volatile organic compounds that caused surrounding areas to stink and residents to be physically ill. The plaintiffs allege that the defendants knew about the Buzby Landfill’s harms and did not disclose these to the plaintiffs when they were buying the homes.
