The Plaintiff, Sinn, lived with her husband and two minor children. The Plaintiff’s minor children, Lisa and Deborah, were standing by the Plaintiff’s mailbox alongside the road. The daughters were standing approximately forty feet from the nearest intersection. An automobile driven by the Defendant, Burd, struck Lisa and hurled her sister, Deborah, through the air. Lisa suffered injuries which resulted in her death. Deborah was struck by the vehicle, though it narrowly missed her. The Plaintiff witnessed the accident from the front door of her home. The Plaintiff brought a complaint, the fourth count of which was for damages sustained from the emotional distress of witnessing her daughter’s death.
