American Railway Express was required to transport a furnace manufactured by Security Stove from Kansas to New Jersey within a reasonable time. The furnace was manufactured with a special combination oil and gas burner for exhibition at a convention in New Jersey in October. Time was of the essence for the furnace to be featured at the convention because a competitor of Security Stove had recently created a similar model and Security Stove wanted to be the first product out of the gate. American Railway Express was on notice from Security Stove that the furnace must have been delivered in time for the convention.
A critical part of the furnace was not delivered to the convention on time.
