Facts
Rizzo and three men planned to rob Rao of the pay roll that Rao was to carry from the bank for the United Lathing Company. Rizzo and the three men started in a vehicle, two of the men had firearms, and started looking for Rao. The men went to the bank, several other buildings that the United Lathing Company were building, and finally to a building at which Rizzo jumped out and entered. By this time two officers were following the men, and the officers, upon Rizzo exiting the vehicle and entering the building, arrested all four men. Rizzo and the men intended to find and rob the pay roll man; however, they never seen or discovered the man before their arrest.
