Charles Rizzo, the defendant, planned to rob Charles Rao, a bank employee, while he was to carry $1,200 from the bank to a company.
He drove around in search of Rao. During their search, police noticed him and became suspicious. Rizzo jumped out of the car and ran into a nearby building, where he was arrested before he ever found Rao. Rizzo was convicted of an attempt to commit robbery. He appealed, arguing that his actions did not constitute an attempt because he had not found or seen the man he intended to rob.
