Defendant left his car keys inside his vehicle while he transacted business inside of a bank. The vehicle was subsequently stolen and driven to a nearby interstate. A state trooper spotted the vehicle (which had been reported stolen minutes earlier by Plaintiff) and pursued the stolen vehicle, resulting in a high-speed police chase. During the 80-MPH chase, the thief ran through a red light at a busy intersection, smashing into Plaintiff’s car.
Plaintiff’s pregnant wife was driving the vehicle at the time of the accident. She died some 14 hours later at a nearby hospital. Prior to her death, she delivered the unborn child, who ultimately died due to complications from the premature delivery. Plaintiff’s four year-old son was also killed as a result of the accident.
