The City of New London had been designated by the state of Connecticut as a “distressed municipality,” prompting state and local officials to target the city for an economic revitalization project. The State authorized finances to create Fort Trumball State Park, and the pharmaceutical company Pfizer said that it would build a research facility immediately adjacent to the park. The City of New London said that the project would create jobs, increase tax revenue, and “revitalize an economically distressed city.” The city used its eminent domain power to acquire property from unwilling landowners in exchange for just compensation.
Petitioners’ houses were not in poor condition, but were condemned because they were located in the development area. Petitioner sued, arguing that taking their property by the government would violate the “public use” restriction of the Takings Clause of the Fifth Amendment.
