North Carolina enacted a law that required all containers of apples sold, offered for sale, or shipped to the state to be of a certain quality (USDA grade) The state of Washington is a major producer of apples, and its State Department of Agriculture requires that apples shipped from Washington in interstate commerce pass a stringent quality test – one that is comparable to, or superior to the one administered by the USDA (United States Department of Agriculture). The North Carolina law would have a significant impact on Washington’s apple market, because it would require producers of apples to remove the Washington inspection label and stamp it with the USDA label, potentially damaging the produce. Other possible solutions would also impose a great burden on Washington apple shippers.
