Dormant Commerce Clause
In this video, you should consider the following:
- The State’s regulation of interstate commerce is permissible when:
- The state regulation does not discriminate against interstate commerce;
- The subject matter is not one which the court concludes inherently requires uniform, national regulation; and
- The state interest underlying the regulation is not outweighed by the burden on interstate commerce.
- The State’s regulation of interstate commerce is NOT permissible when:
- Where the state law is in conflict with an act of congress (Supremacy)
- When the state regulation discriminated or unduly burdens interstate commerce
- Regulations for the conservation of local resources
