Defendant rented a property from the plaintiff for many years and used the site as a manufacturing site. The leases provided that the tenant would indemnify the landlord for any costs resulting from the failure of the tenant or its predecessors lessees to follow environmental laws while suing the premises. Tests of the property’s well water in 1998 showed high levels of a manufacturing pollutant. After the Department of Environmental Quality discovered more pollutants. the defendants stopped drawing well water and and signed an order with the Department of Environmental Quality providing for cleanup of the site. The defendant gave notice to terminate the lease in 2001. The plaintiff filed this suit contesting the defendant’s right to vacate the lease on the date that it gave and indemnify the plaintiff for the costs of cleaning up the pollutants.
