G.D. (plaintiff) sued the Hudson County Democratic Organization and certain individuals (defendants) for invasion of privacy and improper publication of private facts after the defendants published a flyer detailing the plaintiff’s criminal past. The plaintiff pleaded guilty to possession with intent to distribute cocaine and was sentenced to five years in prison. His criminal record was expunged in 2006, however the records remained accessible to the public until 2008. The defendants moved for summary judgment.
