Kauffman was a movie critic who wrote movie reviews for THE NEW REPUBLIC. On March 22, 2004, THE NEW REPUBLIC wrote a letter to Kauffman outlining in writing the parties’ business relationship. The letter clarified that Kauffman was a freelance contributor and the articles were “works made for hire” as defined under the Copyright Act. Kauffman acknowledged and signed the letter. Later, Cardullo wrote a book entitled The Millennial Critic: Stanley Kauffman on Film: 1999-2009. The book contained 141 reviews written by Kauffman from 1999-2009 and was published by RIT.
