John and Elaine Doner (plaintiffs) sued Chester and Jan Snapp (defendants) for breach of contract, requesting $15,000 in compensatory damages for an injury to their expectation interest, plus lost profits. The case arose after the plaintiffs bought three ostriches from the defendants. The ostriches, which were supposed to be one male and two females (a “trio”), ended up being two males and one female. The plaintiffs traded their males ostriches with other breeders, obtaining another male and two female chicks. The defendants filed a motion for summary judgment, arguing that the plaintiffs had not suffered any harm from the alleged breach of contract.
