The plaintiff, her husband, and their child were vacationing in St. Croix, Virgin Islands. One day during this vacation, when the family was getting dinner, they parked their rental car in a lot that was controlled by the United States Department of the Interior, National Park Service. When the family returned to their parked car after dinner, they were confronted by two armed gunmen, who shot and killed the plaintiff’s husband. It was undisputed that the National Park Service had done nothing to deter nighttime parking in this lot. It had no signs prohibiting parking or warning of the dangers of nighttime parking. In fact, the lot was lighted at night.
