Cervelli v. Graves

Cervelli was driving a pickup truck behind Graves’s cement truck. The road conditions were very icy. Graves’s vehicle began to fishtail, and Cervelli attempted to pass Graves’s truck. He was not successful, and the two vehicles collided.
Graves was an experienced driver and had received special licenses for his employment, staying up to date with driving information and techniques for large vehicles.
During a jury trial, jurors were instructed to apply a “reasonable and ordinary prudence” standard to defendant’s conduct, as opposed to one an “extraordinarily cautious” person standard.
