Cay v. State of Louisiana, Department of Transportation and Development

Cay returned home from a 27-day work shift and went to a bar one evening. He had been dropped off at the bar, stayed for about an hour, and declined a ride home electing to make the trek on foot with an open beer bottle.
Some five days later, Cay’s body was found dead. It was apparent he had fallen from a bridge, about thirty feet to the ground, which he needed to cross in order to return home. The bridge was constructed and maintained by the Department of Transportation and Development (DOTD).
After an investigation, it was determined Cay was walking on the wrong side of the road with dark clothes on while intoxicated. There was no evidence of foul-play or suicide.
