Ronald’s grandfather decided, as a surprise birthday present, to give Ronald a lakeside house that Ronald had visited often and expressed his great admiration for. The grandfather’s attorney prepared and the uncle validly executed a deed conveying the property to Ronald, and the attorney then validly recorded the deed.
Unknown to the grandfather, Ronald was experiencing severe financial difficulty and was contemplating filing for bankruptcy. When Ronald learned of the recordation of the deed at his birthday party, he immediately told his grandfather that he did not want the lakeside house and could not accept such an expensive gift anyway.Later, Ronald filed for bankruptcy and the trustee in bankruptcy asserted an ownership interest in the lakeside property on behalf of the debtor’s estate.
