Annie was scheduled to undergo surgery for removal of her tonsils. Doctor Jones, her family doctor, was to perform the operation. The day of the surgery, Doctor Jones was called out of town because of a family conflict. Even though there was no emergency, it was decided by the hospital to go ahead with the operation and substitute Doctor Wells for Doctor Jones. Doctor Wells is considered to be an expert in removing tonsils. Annie was not informed of the switch in doctors.
If Annie sues Doctor Wells on a battery theory, who will prevail?
