After a long day of classes, Sally decided to join her law school friends at the local pub. After grabbing a couple drinks, the friend she was sitting with went to the restroom. David, a complete stranger, came over to Sally, sat down and leaned in to kiss Sally when she was not paying attention. She pulled away, appalled and angered. Does she have a claim for assault?
Assume the same facts from above except that David does kiss Sally. Is David liable for battery?
