Alice Mavrikidis (Plaintiff) was in an automobile accident when her car collided with a dump truck carrying tons of hot asphalt. The driver of the dump truck, Petullo (Defendant), caused the accident when he drove through a red light. The collision caused the dump truck to overturn and spill the contents of the truck onto the Plaintiff’s car inflicting severe burns on her body. Plaintiff sued the driver and the company that the truck was registered to, as well as Clar Pine, the company that hired Petullo to do their asphalt and concrete work. The trial court ruled that Clar Pine was vicariously liable for Plaintiff’s injuries.
