On October, 1996, several wealthy individuals and their controlled entities formed Columbus Hockey Limited, LLC (CHL) for the purpose of seeking a National Hockey League Franchise for Columbus Ohio. John H. McConnell and Lamar Hunt were two investors in CHL. Nationwide made a proposal for the lease for an arena, which Hunt rejected. The CHL investors met. Hunt stated that he found Nationwide’s lease offer unacceptable, while McConnell accepted the lease offer and signed an agreement in their own names. On June, 1997, the NHL expansion committee recommended that the Columbus franchise be awarded to McConnell’s group. The McConnell group filed the present suit seeking a declaratory judgment to establish its legal right to the franchise without inclusion of Hunt.
