Actress Shirley MacLaine Parker (“MacLaine”) (plaintiff) contracted with Twentieth Century-Fox Film Corporation (hereinafter “Twentieth Century”) (defendant) to play the lead female role in the musical film “Bloomer Girl,” to be filmed in California. MacLaine was guaranteed $750,000 in compensation under the contract. Twentieth Century, however, later decided not to produce the film and notified MacLaine of its decision by letter. In the same letter, Twentieth Century offered MacLaine the leading actress role in its western-type film “Big Country, Big Man” (hereinafter “Big Country”), to be filmed in Australia. The compensation offered to MacLaine for “Big Country” was identical to that offered for “Bloomer Girl.” MacLaine had one week to accept the new offer, which she did not. MacLaine sued Twentieth Century to recover the guaranteed compensation under her “Bloomer Girl” contract.
