Shirley MacLaine Parker (Plaintiff) is a famous actress who entered into a contract with Twentieth Century-Fox Film Corp. (Defendant) to star as the lead actress in its motion-picture entitled “Bloomer Girl.” According to the contract, starting on May 23, 1966 Parker was to be paid a “guaranteed minimum” compensation of $53,571.42 per week for 14 weeks, totaling $750,000. Prior to May 1966, Twentieth Century-Fox decided not to produce “Bloomer Girl,” and in order to “avoid any damages” to Parker, offered her the leading actress role in another film entitled “Big Country, Big Man.” The original movie was supposed to be a musical filmed in California, and this film was a western drama set in Australia. Plaintiff refused the offer, and brought suit against defendant to recover the “guaranteed minimum” compensation provided for by her original contract.
