Facts
Willie and Lucille Peevyhouse (collectively the “Peevyhouses”) (plaintiffs) leased their farm to Garland Coal & Mining Co. (“Garland”) (defendant) for a period of five years. Garland intended to use the farmland to strip mine coal, and also agreed to perform restorative and remedial work on the land. Garland failed to do this restorative and remedial work. If the work had been done, the market price of the Peevyhouse’s farm would have increased only by $300. The Peevyhouses brought suit against Garland, seeking $25,000 in damages. The Peevyhouses only received $5,000 in damages. Both parties appealed.
