Veronica Bennett (known as Ronnie Greenfield), her sister Estelle Bennett, and their cousin Nedra Talley were members of a 1960s singing group known as “The Ronettes” (plaintiffs). They signed a contract with the production company Philles Records (defendant). Under this contract, The Ronettes agreed to perform exclusively for Philles Records, who also acquired an ownership right to the group’s performances. The group eventually disbanded and Philles Records went out of business. Capitalizing on a later resurgence of 1960s music, Philles Records eventually sought to make use of the Ronettes’ songs for use in movie and television productions (a process known as “synchronization”). The Ronettes sued Philles Records for breach of contract, alleging that their contract did not provide them with the right to use their recordings for synchronization.
