Facts
A miller (the Plaintiff) required a new part to replace a broken part of the mill, which was inoperable without it. They contracted with a common carrier (the Defendant) to quickly ship a replacement part. While the Plaintiff asked for hastened delivery by a certain date, the Plaintiff did not notify the Defendant of what could result if the deadline was not met. The Defendant delivered the part late, and the mill was inoperable for several more days than planned. The Plaintiffs sued the Defendants for the lost profits resulting from the inoperability of the mill.
