Zuver v. Airtouch Communications, Inc.
Citation:
153 Wash. 2d 293, 103 P.3d 753 (2004)Facts
Defendant offered Plaintiff employment as a sales representative and required Plaintiff to accept certain conditions. One condition was that Plaintiff sign an agreement to arbitrate her disputes. Plaintiff signed the agreement on April 25, 1997, but claims that she was not offered an option to negotiate the terms of her agreement. Plaintiff was diagnosed with fibromyalgia in November 1996, and after accepting Defendant’s offer, her condition worsened. Plaintiff requested accommodation in March 1999. She asked to be allowed to work part-time and to work from home. Defendant denied Plaintiff’s request but allowed her to work part-time in June 1999. By July 1999, Plaintiff could no longer work part-time because of her disability, and she went on medical leave until April 2000. Defendant terminated her employment, and she filed suit.
