The Whites (plaintiffs) purchased a home that lacked its own water supply. Despite the inconvenience, the home was connected by pipes to a well on the property of their neighbors, the Benkowskis (defendants). The Whites entered into an agreement with the Benkowskis, whereby the latter would supply water to the Whites’ home in exchange for a payment of $3 a month and half the cost of any future repairs or maintenance. The relationship between the Whites and Benkowskis eventually deteriorated. Tensions worsened even more so when the Benkowskis shut off the water supply on nine occasions for short periods of time. The Whites sued the Benkowskis for breach of contract.
