Walker (Plaintiff) was a carpenter who was injured when pounding a nail into a cement wall. he brought an action against Armco Steel Co., the manufacturer of the nail (Defendant), in federal district court in Oklahoma under diversity jurisdiction. The district court dismissed the complaint, concluding that it was barred by the Oklahoma statute of limitations. The court of appeals affirmed, finding that there was a direct conflict between the Oklahoma rule regarding commencement of actions and the federal rule, FRCP 3, but existing caselaw held that state law was applicable.
