Tenant leased property from landlord. The tenant noticed a lot of defects in the house — there was no hot water and there was a bad odor. The tenant told the landlord that she intended to withhold rent until the defects were fixed. The defects were not addressed. The Ogden City Inspection Division determined that the property was unsafe and hazardous. The tenant moved out of the house and the landlord sought to recover the unpaid rent.
