The Village of Euclid, the Defendant, was a suburb of Cleveland, Ohio. The Plaintiff, the Ambler Realty Co, owned land in Euclid.The Village Council adopted an ordinance to establish a comprehensive zoning plan to regulate uses and the bulk, area, and height of buildings.
The ordinance divided the village into six use districts, three height districts, and four area districts. The districts were based on the class of use. The classes of use included purely residential, mixed use, commercial, and industrial. The ordinance limited the use of the Plaintiff’s tract to residential purposes which reduced the land’s value by 75% as compared to the anticipated value of the land if it were developed for individual uses. The Plaintiff challenged the zoning ordinance on the basis that it violated the Fourteenth Amendment by depriving the owner of due process and equal protection.
