In December 2006, South Salt Lake City police received an anonymous tip that there was “narcotics activity” at a particular residence. Detective Fackrell investigated the tip and, over the course of a week, conducted surveillance of the house. During that time, Fackrell observed several visitors leaving within a few minutes of arriving at the house, raising his suspicions that the occupants were dealing drugs. Strieff was one of these visitors. Fackrell observed Strieff leaving the house and walking to a nearby convenience store. Fackrell detained Strieff in the store’s parking lot and asked Strieff what he had been doing at the house. During the stop, Fackrell requested Strieff’s identification and relayed the information to a police dispatcher who informed Fackrell that Strieff had an outstanding arrest warrant for a traffic violation. Fackrell then arrested Strieff and searched Strieff incident to arrest discovering a baggie of methamphetamine and drug paraphernalia.
