Criminal Law Keyed to Osler
United States v. Robert Ford
Citation:
726 F. 3d 1028 (8th Cir. 2013)Facts
One night Christina Weston, her cousin Eric Sherman, her friend Shelley Red Earth, and her former romantic interest Robert Ford spent the night drinking and fell asleep at Weston’s home. The next morning, Sherman heard muffling and commotion from Weston’s bedroom. When we went to her room, Ford was existing and shut the door. Sherman asked what happened, and Ford responded that “your cousin is having a fit”. Ford then left the home.
When Sherman entered the bedroom, he found Weston on the floor, curled up, rocking back and forth, and sobbing. She was traumatized. There were also marks on her arm which were not there before. Weston explained that Ford had barricaded her in her own room and sexually assaulted her. She was brought to the hospital for examination and a rape kit where Ford’s DNA was present. Defendant, Ford, was charged with sexually assaulting Weston and kidnapping her for the purpose of not reporting the sexual attack. He was only found guilty of kidnapping.
