Defendant was social friends with his victim, as the victim was the stepsister of the defendant’s girlfriend. Victim testified that she was at her stepsister’s home resting when the defendant approached her on the bed. He threw himself on her, removed her clothes, and had intercourse with her causing her immense pain and bleeding. She said she crying and nodded that she was in pain when asked. At one point he stopped momentarily and she tried to push him off of her, but she was unable to due to his size.
The victim went to the hospital and found lacerations and abrasions consistent with the victim’s statements. Defendant was charged and convicted of aggravated sexual abuse and sexual abuse of a minor.
