While acting as a union officer, the defendant accepted cash payments from a corporation called JRD whose workers he represented in the union. 7 years later, the Department of Labor and Internal Revenue Service visited the defendant at his home. They were seeking his cooperation into their investigation into JDR. The defendant agreed to answer some questions, and asked if he had received any cash or gift from JDR when he was the union officer. He replied no. Then, the officer disclosed that a search of JDR that showed records to the contrary. Defendant did not modify his answers, and he was then indicted and convicted for accepting the cash payments and making false statements to federal officers.
