(Plaintiff) United States Naval Institute was assigned the copyright to Tom Clancy’s popular novel “The Hunt for Red October” and entered into an exclusive license agreement with (Defendant) Charter Communications, Inc. to publish a paperback edition of the book no sooner than October 1985. Defendant shipped its paperback edition to retail outlets early, placing those outlets in a position to sell the book prior to October 1985. The retail sales of the book began on September 15, 1985, and these were substantial so that the book was near the top of the paperback best seller list before the end of September. Plaintiff brought suit for breach of contract and was awarded a preliminary injunction.
