Todd went to the Lighthouse Church and stole $110 from the collection plate. Several members of the congregation witnessed this, and one of them, Richard Voegltin, took off in his car in pursuit of Todd. During the pursuit, Voegltin, who had a preexisting heart condition, had a heart attack and collided with a tree. He died of cardiac arrest.
The state charged Todd with manslaughter, alleging that he caused the death by committing the misdemeanor offense of petty theft. Todd filed a motion to dismiss, arguing that Voegltin was at high risk of having a heart attack and that Todd had no knowledge of this preexisting medical condition. The trial court denied the motion.
