Facts

Sullivan (plaintiff), a professional entertainer, hired O’Connor (defendant) to perform plastic surgery on her nose. Sullivan’s nose was “long and prominent” and she desired surgery to reduce its prominence and shorten it. O’Connor performed three unsuccessful operations on Sullivan that worsened her appearance and resulted in his disfigurement. This disfigurement could not be improved by further surgery. Sullivan’s out-of-pocket expenses incident to the operations were $622.65. She sued O’Connor for breach of contract and negligence. The jury awarded Sullivan $13,500, an amount that substantially exceeded the damages she requested. O’Connor appealed the damage award.
