On a bus owned by New York City Transit Authority (Defendant), students began to vandalize the bus, breaking lights and windows. The bus driver, Mooney (Defendant), assessed the damage and admonished the students, who continued to damage the bus. Defendant then stated he was taking the bus off his route and to the police station. A number of students jumped from the windows. A fourteen-year old (Plaintiff) was in the process of jumping from the window when the bus turned and Plaintiff fell. The bus’s back wheel rolled over Plaintiff’s midsection. The Plaintiff sued Defendants for negligence and false imprisonment.
