Seaver v. Ransom
Citation:
224 N.Y. 233, 120 N.E. 639 (N.Y. 1918)Facts
On her deathbed, Mrs. Beman executed a will that gave $1,000 to Seaver, $500 to Seaver’s mom, $100 to Seaver’s aunt and uncle each, a life estate to Mr. Beman to live in her small estate, and the remainder to the ASPCA.
When the will was read to Mrs. Beman, she said that she had intended to leave the small estate to her niece but did not have the strength to change the will. Mr. Beman promised that he would leave enough for Seaver in his will to make up the difference if Mrs. Beman signed the will as is. However, when Mr. Beman died, it was discovered that he did not leave the difference to Seaver.
