Mr. and Mrs. Ramirez (plaintiffs) signed a simple contract for the sale of a new camper van from Autosport (defendant), at a discount for the trade-in of their older van. On the date of delivery two weeks later, the plaintiffs noted several defects which they were told would be fixed. Months later, when they were finally told that the van was ready, they were left waiting in the showroom for over an hour. Ultimately, the plaintiffs refused to accept the van and asked for their trade-in back, but the defendants had already sold it. The plaintiffs sued for rescission of the contract.
